1. Introduction and Acceptance

These Terms and Conditions (“Terms”) govern your use of www.swarnasol.com (the “Website”) and any enquiry, purchase, rental or service arrangement with Swarnasol [Registered legal entity name] (“Swarnasol”, “we”, “us”, “our”). By using the Website or submitting an enquiry, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Website.

Any separate written quotation, sales order or rental agreement signed with you will also apply. If it conflicts with these Terms, the signed document prevails.

2. About Our Business

Swarnasol supplies industrial and commercial cleaning equipment, including sweepers, scrubbers, vacuums and pressure washers. We also provide spares and short-term and long-term rental solutions, with trained operators and GPS-enabled machines where applicable. 3. Use of the Website

You agree to use the Website only for lawful purposes. You must not:

• provide false, misleading or incomplete information in enquiry or contact forms;
• attempt to gain unauthorised access to the Website, its servers or related systems;
• introduce viruses, malware or harmful code, or interfere with the Website’s operation;
• copy, scrape or reproduce Website content for commercial purposes without our written permission;
• use the Website to send spam or unsolicited promotions.

The Website is intended for businesses and adults aged 18 or above.

4. Product Information

We try to keep product descriptions, specifications, capacities, productivity figures (for example, “up to 6500 sqm”) and images accurate. However:

• Specifications and images are indicative and may vary by model, configuration or manufacturer updates.
• Productivity figures are based on ideal conditions. Actual performance depends on floor type, layout, operator skill and maintenance.
• We may change or discontinue products without notice.

Product listings on the Website are an invitation to enquire, not a binding offer to sell.

5. Enquiries, Quotations and Orders

• Submitting an enquiry does not create a contract. A contract forms only when we issue a written quotation or sales order and you accept it in writing, or as otherwise agreed.

• We may decline or cancel an order, for example because of stock, pricing errors or inability to meet requirements. In that case we will refund any amount paid for it.

6. Pricing and Payment

• Prices, including rental rates shown on the Website, are indicative and may change without notice. The price on your written quotation applies.
• Payment terms (advance, milestone or credit period) will be stated in the quotation or invoice. The Website does not currently accept online payments.
• Late payments may attract interest at [[X]]% per month and may lead to suspension of services or recovery of rental equipment.
• Goods remain Swarnasol’s property until full payment is received.

7. Delivery, Installation and Training

• Delivery timelines are estimates, and we are not liable for delays outside our reasonable control.
• Delivery charges, transport and unloading arrangements will be stated in the quotation.
• Risk of loss or damage passes to you on delivery. The customer must inspect goods on receipt and report visible damage or shortages within [[48 hours]].
• Where included, we will provide basic operation and safety training. You must ensure only trained persons operate the equipment.

8. Warranty

• New equipment carries the manufacturer’s warranty for the period stated in your invoice or the product documentation.
• The warranty covers manufacturing defects only. It does not cover:
  • wear-and-tear parts such as brushes, squeegees, filters, belts and batteries beyond their stated terms;
  • damage from misuse, negligence, accidents, unauthorised repairs or incorrect voltage or charging;
  • use of non-genuine spares or consumables;
  • failure to follow the operating and maintenance instructions.
• Our remedy is limited to repair or replacement of the defective part, at our option.
• Warranty is void if the machine is modified or serviced by unauthorised persons.

9. Spares and Service

Spares are supplied subject to availability. Compatibility is the customer’s responsibility unless we confirm it in writing against your machine model and serial number. Service visits, annual maintenance contracts and repairs are charged as per the agreed quotation.

10. Rental Terms

These terms apply to all rental of sweepers, scrubbers and related equipment.

10.1 Rates and duration

• Rental is charged on the basis stated in the quotation (for example, per hour), plus GST.
• Rates shown on the Website are indicative. Minimum hours, transport, mobilisation and operator charges may apply as stated in the rental quotation.

10.2 Security deposit and payment

• A refundable security deposit of [[₹ amount]] and/or advance payment may be required before delivery.
• Invoices are payable as per the agreed payment terms.

10.3 Customer responsibilities

• Use the equipment only for its intended purpose, at the agreed site, and within its rated capacity.
• Provide safe access, a suitable power supply or charging point, and a secure storage area.
• Not move the equipment to another site, sub-let it, lend it, or allow untrained persons to operate it.
• Keep the equipment in good condition, and report faults immediately. Do not attempt repairs.

10.4 Operators
Where we provide trained operators, they remain our personnel, and you must give them a safe working environment and reasonable site induction.

10.5 GPS tracking
Rental machines may be GPS-enabled. By renting, you agree that we may track machine location, operating hours and usage for billing, safety, maintenance and asset protection, as described in our Privacy Policy.

10.6 Loss, damage and insurance

• You are responsible for loss, theft or damage to the equipment during the rental period, except for normal wear and tear.
• You must bear the repair or replacement cost for damage caused by misuse, negligence or unauthorised use.
• You are responsible for insuring the equipment against theft, fire and damage during the rental period unless we agree otherwise in writing.

10.7 Return and termination

• Equipment must be returned on the agreed date in the condition it was delivered, with all accessories.
• We may recover the equipment immediately if you breach these Terms, fail to pay, or misuse it, and you must give us access to do so.
• Cancellation by the customer may attract charges as stated in the rental agreement.

11. Intellectual Property

All Website content, including text, logos, graphics, images, layouts and product literature, belongs to Swarnasol, or to our manufacturing partners and their licensors, and is protected by applicable intellectual property laws. Brand names and logos of manufacturing partners remain the property of their owners. You may view and print Website content for personal or internal business reference, but you may not copy, modify or distribute it commercially without our prior written permission.

12. Third-Party Links and Services

The Website links to third-party services such as WhatsApp, Google Maps, and social media platforms (X, Facebook, Instagram, YouTube). We do not control these services and are not responsible for their content, availability or privacy practices. Your use of them is at your own risk and subject to their own terms.

13. Disclaimer of Warranties

14. Limitation of Liability

To the fullest extent permitted by law:

• Swarnasol is not liable for any indirect, incidental, special or consequential loss, including loss of profit, business, production or goodwill, arising from use of the Website, products or services.
• Our total liability for any claim relating to a product or service is limited to the amount you paid for that specific product or service (or, for rentals, the rental charges for the relevant period).
• Nothing in these Terms excludes liability that cannot be excluded under Indian law, such as liability for fraud or wilful misconduct.

15. Indemnity

You agree to indemnify and hold Swarnasol harmless from claims, losses, damages and expenses (including reasonable legal fees) arising from your breach of these Terms, misuse of the Website or equipment, or violation of any law or third-party rights.

16. Safety and Compliance

You must operate all equipment according to the operating manual and applicable safety, electrical, environmental and workplace regulations. You are responsible for site safety, including wet-floor precautions, signage and safe battery charging and handling.

17. Force Majeure

We are not liable for delay or failure caused by events beyond our reasonable control, including natural disasters, fire, flood, epidemic, strikes, war, government action, transport disruption, power failure, or supplier delays.

18. Termination and Suspension

We may suspend or end your access to the Website or our services at any time if you breach these Terms or misuse the Website. Provisions that by nature should survive termination, such as payment, intellectual property, liability, indemnity and dispute resolution, will continue to apply.

19. Privacy

Your use of the Website is also governed by our Privacy Policy, which explains how we collect and use your personal data.

20. Governing Law and Dispute Resolution

• These Terms are governed by the laws of India.
• The parties will first try to resolve any dispute through good-faith discussion.

• Assignment: you may not transfer your rights under these Terms without our written consent. We may assign ours in a business transfer.

We may update these Terms from time to time. The “Last Updated” date shows the latest version. Continued use of the Website after changes means you accept the updated Terms.
